(Decision of the CU Commission 319 of 06/18/10 “On technical regulation in the Customs Union”)

The Customs Union is formed by three states-parties Belarus, the Republic of Kazakhstan and the Russian Federation. This is a new form of trade and economic merger of the participating countries. Within the Customs Union, a single customs tariff and uniform requirements for product safety are applied. There is a certificate of the Customs Union in action which is issued for products designated in a single list of goods that can apply to the customs territory. The main documents of the customs union include the agreement on the Commission of the Customs Union, the agreement on the Mutual Recognition of Accreditation of Certification Bodies, as well as performing work on the conformity assessment of performing laboratories. In addition, certification of the customs union takes place in accordance with the rules and regulations specified in the agreement on Creation of the Common Customs Territory, in the CU agreement on sanitary measures and in the agreement on Implementation of Harmonized Policy in Field of Phyto-sanitary and Sanitary Measures.

The certificate of the Customs Union initiated the formation of a new certification system. A package of documents has been developed, which stipulates all the conditions for the functioning of the Customs Union. The certificate of the Customs Union for goods is issued, guided by a single list of goods subject to sanitary and epidemiological supervision (control) at the customs border and the customs territory of the Customs Union; uniform sanitary and epidemiological and hygienic requirements for goods subject to sanitary and epidemiological supervision (control); uniform types of documents confirming the safety of products (goods) transported across the customs border of the Customs Union and in the customs territory of the Union.

The issued certificates of the Customs Union confirm the conformity of the products to the national legislation of the member-states of the Customs Union.

The package of documents required by the organization in order to obtain certificate of the Customs Union may vary depending on the place of manufacture of goods and their type. So, to issue a certificate for products produced outside the customs territory, company must provide the contractor with statement and manufacturer’s declaration to confirm the safety of goods. Also the main package should  include copies of technological instructions, regulations, technical conditions and standards, copy of the document from the manufacturer of controlled goods.
